2) Introduction

Bigdates.ai provides digital tools and services including invitation and event website creation and related web, desktop, and client-facing applications. These Terms apply to all users of our website and services.

3) Eligibility

You must be at least 18 years old to use our services. By using Bigdates.ai, you represent that you are legally competent to enter into a binding agreement.

Except for content owned by users, all intellectual property on the platform, including software, branding, design, and materials, is owned by Bigdates and/or its licensors. You are granted a limited, non-transferable right to use the services as permitted by these Terms.

You are responsible for keeping your account credentials confidential, maintaining accurate profile and billing details, and all activity under your account. We may suspend access if account misuse, fraud, or suspicious activity is detected.

"Your Content" includes text, images, audio, video, event data, or other material you upload or use on Bigdates.ai. You retain ownership of your content.

By using our service, you grant Bigdates a limited, non-exclusive license to host, process, reproduce, and display that content solely to provide and improve the service. You confirm your content does not violate third-party rights or applicable law.

8) Service Plans, Pricing, Billing & Taxes

Plan details and pricing are shown on our platform and checkout pages. Prices are in INR unless otherwise specified. Applicable taxes (including GST) are charged as per law. Paid features are activated after successful payment confirmation.

For recurring subscriptions, you authorize charges as per selected billing cycle until cancellation.

9) Payment Terms

Payments may be processed via approved payment partners (including Cashfree) using available methods such as UPI, cards, net banking, wallets, and others.

A transaction is considered successful only after gateway or bank confirmation. In case of payment failure, reversal, pending transactions, or fraud flags, service activation or continuation may be delayed, restricted, or declined.

10) Refunds, Cancellations & Chargebacks

Our refund and cancellation terms are governed by the Refund Policy available at /refund_policy.

If eligible, refunds are processed to the original payment method within the stated timeline. Bank and payment network settlement time may vary. Users must contact support at info@bigdates.ai before initiating chargebacks. Fraudulent or abusive chargebacks may result in suspension or termination and recovery action.

Bigdates services are delivered digitally. No physical products are shipped. Service activation is generally immediate after successful payment, but may take up to [X] hours in exceptional situations.

14) Third-Party Services

Our platform may rely on third-party services such as payment gateways and hosting providers. We are not responsible for failures, delays, or policy changes of third-party platforms outside our reasonable control.

15) No Warranties

The website and services are provided on an "as is" and "as available" basis. Bigdates disclaims all warranties, express or implied, to the maximum extent permitted by law.

16) Limitation of Liability

To the maximum extent permitted by law, Bigdates and its officers, directors, employees, and affiliates are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the services.

Our aggregate liability for any claim shall not exceed the total fees paid by you to Bigdates in the three (3) months immediately preceding the event giving rise to the claim.

You agree to indemnify and hold Bigdates harmless against liabilities, damages, claims, costs, and expenses (including legal fees) arising from your breach of these Terms, misuse of services, or violation of any law or third-party rights.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

Bigdates may assign, transfer, or subcontract its rights and obligations under these Terms. You may not assign or transfer your rights or obligations without our prior written consent.

21) Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, courts at Ernakulam, Kerala shall have exclusive jurisdiction.
